Terms of Service

1. Acceptance of terms

These Terms of Service (“Terms”) constitute a legally binding agreement between you (“User,” “you,” or “your”) and Pymander INC. DBA 16s Technologies INC. (“Company,” “we,” “us,” or “our”), governing your access to and use of the 16s platform, including the SMS-based website building service, AI designer assistant (“Six”), the website at https://try16s.app, and all related services (collectively, the “Service”).

By texting our designated phone number, accessing our website, or otherwise using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, do not use the Service.

We reserve the right to modify these Terms at any time. Continued use after modifications constitutes acceptance.

2. Eligibility

You must be at least 13 years of age to use the Service. If you are under 18, you must have the consent of a parent or legal guardian. By using the Service, you represent and warrant that you meet these eligibility requirements.

3. Description of service

16s is an AI-powered website building platform operating primarily through SMS and voice conversations. The Service includes:

• SMS and voice interactions with Six, our AI designer assistant.
• AI-generated website design, content, and deployment.
• Website hosting on 16s subdomains.
• Ongoing editing and iteration via conversation.
• Additional features as made available.

The Service is provided on an “as-available” basis.

4. Account registration and communication

Your phone number serves as your primary account identifier. By using the Service, you provide express consent to receive SMS, MMS, and voice communications from us. Standard message and data rates from your carrier may apply. You may opt out of promotional messages at any time by texting STOP.

5. Fees and payment

Certain features of the Service require payment. All fees are non-refundable unless otherwise stated. Pricing may change with reasonable notice. Non-payment may result in suspension of your access to paid features.

6. User content and intellectual property

6.1 Your content

You retain ownership of original content you provide (“User Content”). You grant us a worldwide, non-exclusive, royalty-free, sublicensable license to use User Content solely for operating, providing, and improving the Service.

6.2 Generated content

Subject to your compliance with these Terms and payment of applicable fees, you receive a non-exclusive, worldwide license to use Generated Content for personal or business purposes. We retain rights to use anonymized, aggregated, or de-identified versions of Generated Content for improving the Service, training AI models, showcasing capabilities (without identifying you), and internal research and development.

6.3 Company intellectual property

All intellectual property rights in the Service — including the platform, Six AI persona, algorithms, design systems, archetypes, taste engines, software, branding, trademarks, trade dress, and underlying technology — remain the exclusive property of the Company.

7. Acceptable use

You agree not to use the Service to:

• Create, distribute, or promote illegal or harmful content.
• Violate any applicable law, regulation, or third-party rights.
• Infringe on intellectual property rights of others.
• Distribute malware, phishing pages, or other harmful content.
• Impersonate any person or entity.
• Reverse-engineer, decompile, or extract source code of our systems.
• Circumvent security measures or access controls.
• Send spam or use unauthorized bots or scrapers.
• Create content that exploits minors.

8. AI-generated content disclaimers

• AI-generated content may contain errors. You are responsible for reviewing all content before publishing.
• We make no guarantee of accuracy, completeness, quality, or suitability of generated content.
• Generated content may inadvertently resemble existing works. You are responsible for ensuring non-infringement.
• Six is not a substitute for professional advice (legal, financial, medical, or otherwise).

9. Website hosting and availability

We do not guarantee uninterrupted availability of Generated Sites. We are not liable for downtime beyond our reasonable control. We may remove websites that violate these Terms.

10. Third-party services

The Service integrates with third-party providers including SendBlue, Anthropic, hosting providers, domain registrars, and payment processors. Their own terms of service may apply to your use of those services.

11. Disclaimer of warranties

The Service is provided “as is” and “as available” without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that: (a) the Service will be uninterrupted, error-free, or secure; (b) AI-generated content will be accurate, complete, or non-infringing; or (c) the Service will meet your specific requirements.

12. Limitation of liability

To the maximum extent permitted by law, the Company shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising out of or related to your use of the Service.

Our total aggregate liability for all claims shall not exceed the greater of (a) the amounts you have paid to us in the 12 months preceding the claim, or (b) one hundred U.S. dollars ($100.00).

13. Indemnification

You agree to indemnify and hold harmless the Company and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or related to: (a) your use of the Service; (b) your User Content; (c) your violation of these Terms; (d) your violation of any third-party rights; or (e) content published on your generated websites.

14. Termination

We may suspend or terminate your access to the Service at any time, with or without cause. You may terminate your account by contacting us. Upon termination, Sections 6, 11, 12, 13, 15, and 16 shall survive.

15. Dispute resolution

15.1 Governing law

These Terms are governed by the laws of the State of Delaware, without regard to its conflict of law principles.

15.2 Arbitration

Any disputes arising out of or related to these Terms shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules, conducted in Delaware or remotely.

15.3 Class action waiver

You agree to resolve disputes on an individual basis only. You waive any right to participate in a class action or class-wide arbitration.

15.4 Small claims exception

Either party may bring an individual action in small claims court.

16. General provisions

• Entire agreement: these Terms, together with our Privacy Policy, constitute the entire agreement between you and the Company regarding the Service.
• Severability: if any provision is found to be unenforceable, the remaining provisions will continue in full force and effect.
• Waiver: our failure to enforce any provision does not constitute a waiver of that provision.
• Assignment: you may not assign your rights or obligations without our prior written consent. We may assign our rights and obligations without restriction.
• Force majeure: we are not liable for any failure or delay in performance due to circumstances beyond our reasonable control.
• Notices: we may provide notices via SMS, email, or posting on the Service.

17. Telecommunications compliance

By using the Service, you consent to receive autodialed and/or pre-recorded SMS and voice communications. This consent is not a condition of purchase. Standard message and data rates may apply. You may opt out at any time by texting STOP. We are compliant with TCPA and CTIA guidelines.
